Terms & Conditions – Manpower Supply Services

Please read these Terms carefully before using our services.

1. Introduction

These Terms and Conditions (“Terms”) govern the relationship between the Manpower Provider (“Company”) and the Employer / Client (“Client”) who engages the Company for manpower supply services.

By availing the services of the Company, the Client agrees to comply with and be legally bound by these Terms and Conditions.

The Company acts solely as a manpower sourcing and supply service provider and does not assume responsibility for the operational conduct of the personnel once deployed at the Client’s workplace.

2. Scope of Services

The Company provides manpower recruitment, sourcing, and placement services to Clients who require workforce support for their business operations.

The services include:

  • Identifying suitable candidates
  • Screening and shortlisting applicants
  • Providing manpower to the Client as per requirement
  • Coordinating between Client and staff where necessary

The final decision to hire, accept, or deploy any candidate provided by the Company rests solely with the Client.

3. Employment Relationship

All manpower supplied by the Company will perform their duties under the supervision, direction, and control of the Client at the Client’s workplace.

Once the manpower joins the Client’s workplace:

  • The Client is responsible for assigning tasks
  • The Client will supervise daily activities
  • The Client will ensure workplace safety and compliance

The Company shall not be responsible for the daily operational behavior or performance of the staff after deployment.

4. Staff Conduct and Behavior

The Company makes reasonable efforts to verify the identity and background of candidates before recommending them to Clients.

However, the Company does not guarantee the behavior, performance, or conduct of any individual staff member once placed at the Client’s workplace.

If any staff member:

  • Commits theft
  • Engages in misconduct
  • Fails to perform duties
  • Creates disputes
  • Causes financial or operational loss
  • Violates company policies

Then the responsibility for managing such matters lies solely with the Client.

The Company shall not be held liable for any acts of misconduct, negligence, theft, fraud, or criminal activity committed by the staff after deployment.

5. Liability Disclaimer

The Company shall not be responsible for any loss, damage, theft, fraud, or illegal activity committed by any staff member supplied to the Client.

The Client acknowledges that:

  • Staff members operate under the Client’s supervision
  • Any security arrangements at the workplace are the Client’s responsibility
  • The Company does not control the staff once they begin working at the Client’s premises

Therefore, the Company shall not bear any legal, financial, or criminal liability arising from the actions or omissions of any deployed staff.

6. Replacement Policy

If the Client finds any staff member unsuitable due to performance issues, misconduct, or inability to perform assigned duties, the Client may notify the Company.

Upon receiving such notification, the Company may attempt to provide a replacement candidate within a reasonable time, subject to availability.

However, replacement of staff shall not imply that the Company accepts liability for the actions or behavior of the previous staff member.

7. Client Responsibilities

The Client agrees to:

  • Provide a safe and lawful working environment
  • Clearly communicate job responsibilities to the staff
  • Supervise and monitor the staff during working hours
  • Ensure compliance with workplace policies and legal regulations

The Client must immediately inform the Company if any serious issue arises involving the supplied staff.

8. Legal Compliance

Both the Company and the Client agree to comply with all applicable laws, labor regulations, and employment-related rules in India.

The Client shall ensure that staff members are not assigned any illegal or hazardous activities beyond the agreed scope of work.

The Company shall not be responsible for any legal consequences arising from misuse of staff or violation of laws by the Client.

9. Legal Disputes and Jurisdiction

In the event of any dispute, claim, or legal matter arising out of or related to the services provided by the Company, both parties agree to attempt to resolve the issue amicably through discussion.

If the matter cannot be resolved mutually, the dispute shall be subject to the exclusive jurisdiction of courts located in Mumbai, Maharashtra, India.

No other court or legal authority shall have jurisdiction over such disputes.

10. Limitation of Liability

Under no circumstances shall the Company be liable for:

  • Theft or property damage
  • Employee misconduct
  • Workplace disputes
  • Loss of business or profit
  • Staff negligence
  • Criminal activities committed by staff

The Client accepts full responsibility for monitoring and supervising staff once they begin work at the Client’s premises.

11. Modification of Terms

The Company reserves the right to modify, update, or revise these Terms and Conditions at any time without prior notice.

Any updates will be effective immediately upon being published on the Company’s website or communicated to the Client.

Continued use of the services after such modifications constitutes acceptance of the revised Terms.

12. Acceptance of Terms

By using the manpower supply services of the Company, the Client confirms that they have read, understood, and agreed to these Terms and Conditions.

These Terms constitute a legally binding agreement between the Company and the Client.
